Is justice a myth, or does it really bring closure?

Is there really such a thing as justice? When two sides are in such vehement opposition, sometimes it seems only the lawyers are the winners. People talk about closure, but it seems that satisfactions n in the court is something of a myth. Or am I just jaded...?

            • Having had to go to court I can tell you it's very often unfair. Even if you win you can sometimes lose. I won and was awarded a sum of money that never eventuated but when I rang the court I was told that was a separate action and I would have to go to court again. I walked away and I could have been filled with hate, which they so justly deserved, but I decided I would be the one hurt, not them and as a Christian I believe everyone will have to answer for their actions one day, and who knows, perhaps something has happened to those people over the years because sometimes what goes around comes around. Lawyers will tell you it's not about justice it about the law, and they aren't the same thing.

              • I don't believe that justice brings closure, if a criminal is jailed for life for murder it does not bring the dead back to his/her loved ones, even if a thief comes a burgles your house and takes every thing you owed, do you get everything back again if he is jailed, No you never get back what you lose regardless the length of sentence, Put the criminal in the middle of the victims and their family and let them sort the beast out, saves the tax payers a lot of money, Sadly I don't believe with the death sentence. but I do with a good bashing and wipe the floor with them

                • In the biblical system if you took a life you had to take responsibility for the people left behind, so in effect they became your family and you had to make restitution. I believe people who steal and are caught should have to make restitution. Perhaps it would make them think twice before they committed another crime.

                • I think it depends on individual people and individual cases. For example ... if an innocent child is killed by a drunk driver .... even if the person goes to jail FOR LIFE - for me there would never really be "closure". In saying that - I would try and get on with my life and find some joy for the sake of others ... but it would always be there................And I think it would be MUCH harder if the person responsible got some tiny sentence which is often the case - out in a few years.

                  • I think it depends on the subject.We can all be stubborn & unrelenting in our opinions .It takes a special person to listen to opposition fairly .When that occurs, a lawyer has to be consulted & a case may be won .But at what cost The lawyer has earned his fee & justice has been given .I personally find the sentences given don't always suit (the crime)the situation & the shortening of the sentences given (for good behavior)Is a farce .Then I query whether justice has been done

                          • The justice system is set up with the assumption that an innocent person should never end up in it - if you do you're screwed. You lose your entire life and forget innocent until proven guilty...if that even existed everyone would get name suppression. For those who do go in guilty or not you are treated as less than human only to be followed by torture from other inmates or the guards themselves. We then somehow expect these people to come out reformed and act surprised when they act their trauma out in society. People who end up in there are not 'bad' but a reflection of societies failure to help them when they most likely were being abused and neglected as children. The person who puts them in jail is never satisfied that it's enough. I don't see justice in any of that. Jails make our society less safe in the long term, we need to wake up to that fact.

                            • Not always true VESTA. They choose to do wrong then they can do the time! Some probably should not be there, because some have wrongly--- been locked up.. but most deserve it. You can't use a bad up bringing as a excuse.

                              • At least the crimminal is caught and sentenced in a court room and punished in some way, depending on the offence. It does some way give some part closure. Everyone should be satisfied. I would be satisfied & a sense of justice prevails.

                                  • Justice is a myth because the law gets in the way. Justice is about righting wrongs and punishing offenders but with the sentences handed out to rapists, murderers and those with no respect for human life, it is obvious justice doesn't exist . Justice is seen occasionally maybe, but people have as much chance of winning lotto. Lawers too often defend guilty parties and the police and prosecutors sometimes convict innocent people and all because of an archaic law system that drastically need overhauling. Unfortunately, it earns a good income so why change anything?

                                        • My opinion is that if U do an injustice…steal from someone, injure someone, the offender should be made to take care of the situation…persay to the robbed, work to repay the debt… work to help the injured person to recover and pay their medical costs…maybe then it will feel like justice has been served…people are walking away will no regard for the consequences that are caused by their selfish actions…just a thought…as I have been robbed & found that the young person didn’t have to help repair the damage or work to repay the debt that they caused…

                                        • I don't understand your position, Surely when partise and vehemently opposed the outcome is achieved through mediation and/or negotiation. in such a situation justice does not have a dog in the fight. On the other hand where a criminal act against a person or property and justice has a role, But even then the issue is not about closure for the victim, it's about addressing the miscreant's behaviour and 'ensuing' consequences.

In Civil Matters it's a Joke where only the Legal People Win and everyone else gets to feel as if they have been cheated. In Criminal Matters it is at best the wronged feeling as if they GET EVEN with the person/s who have wronged them. IN many countries around the world the family of the wronged get to decide what should happen and this is never justice it is always REVENGE.

                                              • Justice does, or used to, exist. Take as an example a marriage break-up - No, this has not happed to me - If it ends up in the Courts what happens? The judges seem to automatically side with the female partner. She is always considered to be the "victim" - a word which is grossly over-used - she gets the House, a share of the man's income - even if she has a Full Time job - a share of his Superannuation - even if he has been in it for over 20 years before they even met - let alone married. The male is always the "offender" - and that includes if the marriage broke because the female had an affair with another man or woman, It is no wonder people enter into Pre-Nuptial Agreements. Check out the sentences handed out to the worst scum of the Earth, Paedophiles. They destroy children's lives and the courts slap them on the wrist and gives them a year or two in prison, then some bleeding heart Parole Board grants them parole only to have them go out and offend again - sometimes within hours, days, weeks of being released. The child is condemned to a Life Sentence. Is that Justice? Of course not. They should get Life - Term of Life. None of those 25 year sentences. These scum are incapable of "rehabilitation" because, as they would argue, they have done nothing wrong because they "love" children! When we read of some of the sentences given we immediately wonder if the Judge - male or female - belongs to that very secret, very large club of Child Sex Offenders which reportedly is spread across the World. Murderers kill a number of people they get Concurrent Life Sentences - i.e they get 25 years for each murder but only serve 25 years - instead of getting Consecutive Sentences which means they serve 25 years for the 1st murder and at the end of that they start another 25 years and so on. That is Justice. They ended the lives of a number of people, the surviving members serve a Life Sentence , the murdered is dead for eternity.

                                                • That is indeed true under our current biased family law system, romac. Both sexes are supposed to be equal before the Law, yet its often the women who financially benefit the most, even if they have contributed less.

                                                • I disagree The judge does not automatically side with the female USUALLY both people involved contributed to establishing home & assets .If a woman has been given custody of any children she does get more than 50% .I do agree in certain situations eg paedophiles.the sentence for their crime is pathetic & WHY reduce the sentence aren't they given the sentence as punishment why reward them ??.The judge has no control over term of sentences .They are given what they can give & the Maximum they can give .Ask your local member of parliament & get him to advocate longer fixed sentences with NO parole

                                                  • You only have to re-read John Mortimers, series of Rumpole's escapades. While the books are bloody good, They do beg these questions raised in this topic. A lot of cases go to court with some people destined to never gain or achieve a sense of closure. Whilst this is sad, people need to recognise what can be done via the court system, and what can not. Everyone is aware of the (usually rich!) or quick to complain! ones who don't hesitate to further line the fur? pockets of lawyers. We all know the sort- (The he said/she said sorts and any handy pawns) e.g. children and pets that are the unfortunate ones drawn in their mess.

                                                            • We can never have satisfaction on any decision the court of Justice enter into with criminal that did us wrong, you can appeal, but it costs a lots of money , so therefore, its a waste of your money and resources, you can call it justice incomplete, it does not seat right inside you always. The Good Book {BIBLE} says "Forgive ". Blessed are those who forgive, they are forgiven. Happy are those with pure heart, they can see God.

                                                                • In New Zealand our justice system is a joke. We have a thing called cultural reports where upon the judge is given a report on the offenders up bringing. 95% of the time it is a sob story and the offender is given a reduced sentence, home detention, or community service. In most cases it does not fit the crime. We are losing faith in the system. 80 % go on to re- offend. And our prison system is a joke. And before someone goes on about rehabilitation….. I have worked in the justice system and have had first hand experience with it.

                                                                    • Concept of Justice is a big thing in society. The above image is that of a statue of Lady Justice, from the Roman Goddess of Justice : Iustutia or Justitia, introduced by the Roman Emperor Augustus Caesar. The blindfold means that the Law is impartial to the wealth or social status of the parties involved in the case. The scale (left and right) are points which are 'for' and 'against' the presented case. Just out of view : The lady has a sword in her hand which symbolises the quick and final nature of the passed judgement : sort of like the Gulliotine! Once that sword is used the result could be irreversible! Of course, it's possible these days to appeal a result to a higher court. Yes there's irony in the monetary spending that may take as well as the fees needed for getting Good Lawyers! But, at the end of day Experience, Knowledge and Wisdom is what the system of Justice is built upon! :-)

Closure often only occurs when the victims feel the punishment fits the crime, and sadly for murder a life in prison never brings closure because the perpetrators still get to keep their life

                                                                          • I knew a couple whom had lost their son with a parcel bomb and the case was heard against his ex girlfriend and her new boyfriend in a court of law. They were charged with his murder and both got 25 to life for killing him. The police even knew which can opener they used to make parts of the bomb. The people who commit these crimes must pay highly for their actions, no one forced them to do what they did. While it doesn't bring their son back it does stop these people from doing this type of thing again to another family and I think that is what they got out of it. That is all I think some one wants out of this sort of case. Especially if a life has been taken and no one wants that for another family. People like that need to be taken off the streets and made to pay dearly.

If you have a civil complaint and need to take it to court, then you can forget about legal-aid. Your on your own! Have to have deep pockets to pay for a lawyer to help you.

                                                                                              • There is an interesting case being played before the worlds media , and that is Johnny Depp and his ex partner. Both have accused each other of violence and its brought their families and friends into it. Its embarrassing for both of them as it will probably ruin both of what's left of their careers. I think both were equally guilty of violence. It will be interesting to see which way the VERDICT GOES? I think civil cases are often quite notorious for using up alot of court time and money. The longer it goes on, the bigger the pay-check for the lawyers involved, representing both the parties. There needs to be limit placed on the length of time of a court case . Sometimes it just comes down to how much money you have. So much for justice!

                                                                                                  • Try comming up against a government agency or even a government employee, and see how you fare. It happened to one lady I knew, and she had to take court action, to prevent her elderly mum being put into care...against her wishes. Several siblings apparently lied to certain authority's. Having to spend money on her case. The law protects those in authority more than those who have less power, the ordinary citizens. The whole justice system needs to change. The people who write the LAWS, and therefore that influences the court system and those who work within the confines of its walls. Our political masters who have a major say in parliament in regards to our laws. We have a current outcry over legislation in regards to PC-- matters, relating to gay rights and transgenders in private and the religious schools. It seems the majority of our corrupt politicians... support, allowing too many rights for those whose sexualities are of the abnormal kind, against the wishes of the conservative and Christian schools. Morals are going the way of the dinosaur. Its all about my rights, and not the rights, of the majority...and what's best for society as a whole.

                                                                                                    • Of course, there is always going to be people that are not happy with how the justice system works, in their case its seems to be really injustice. Lawyers are all there to win... regardless of who is really in the right. Take what happens in family cases for instance, child custody cases, many are dissatisfied with how the family justice system works. What's often sometimes ----- overlooked...is the moral implementation of the law. Judges and jury's don't always make the right decision on behalf of all parties. Sometimes its the bad party that seems to get the better outcome. The law, like everything, isn't perfect. Why would you expect it to be?

Eg: 2009 bushfire class action whereby I was paid about 20% of my losses. So the lawyers made millions but I was unable to rebuild my house. How is that fair?

                                                                                                            • JUSTICE does not really exist because in civil cases you can only SEEK justice IF you can afford a solicitor / barrister ( lawyer ). In criminal cases often the punishment does not fit the crime. In some criminal cases ( especially in USA ) many INNOCENT people are convicted and sent to prison. Some of these innocent people have been executed over the years. Many other innocent people spend 20 to 30 years in prison before they are proven to be innocent. Therefore, does JUSTICE really exist ?? My answer is NO.

                                                                                                              • No, I agree. I think the law gets it right maybe ?20% of the time. You know, like on those rare occasions where a decent person of any colour gets community service for a minor crime or when a truly evil person gets their comeuppance and is jailed for life. I don't think this always happens. And I think that it has always happened that innocent people have been convicted, merely for being in the wrong place at the wrong time. It would be really good if lie detectors were more reliable

                                                                                                                  • The more money you have the more chance you get off or get a slap on the wrist. However, I see young kids enter kindergartens and brutally kill Alpaca's, rabbits etc. or run down a lot of Emu or Kangaroos on the road laughing and filming it and when they get caught (sometimes) and go to court they get no sentence as the poor little thugs have had a hard upbringing. That is not justice but they think they then have the right to just keep doing it. We are in the middle of teen crime at the moment here with gangs running riot in cities and neighborhoods. They steal cars, break into homes, bashing innocent people and gender does not matter, they have fights and stab each other often with a young person dying. They get caught, go to court, slap on the wrist and out back doing it all over again that night. Justice is not a myth but I do think it is very light weight and it's not good enough.
